1. Who we are

The Houston Pumpkin Festival is produced by Houston Family Fun LLC (“we,” “us,” and “our”). This Privacy Policy explains how we collect, use, share, and protect information when you visit houstonpumpkinfest.com (the “Site”), buy tickets, attend the Festival, or sign up to receive text messages from us. It applies together with our Terms & Conditions.

2. Information we collect

Information you give us. Your name, email address, mobile phone number, and anything you choose to include when you contact us, sign up for text messages, or accept our Waiver & Release of Liability.

Ticket purchases. Tickets are sold through a third-party ticketing provider, which processes your payment under its own terms and privacy policy. We receive the details of your order, such as your name, email address, and the tickets you bought. We do not receive or store your full payment card number.

Information collected automatically. When you visit the Site, our hosting provider and Google Analytics collect standard technical information, such as your IP address, browser and device type, the pages you view, the site that referred you, and your approximate location. Google Analytics uses cookies to do this; see Section 6.

At the Festival. We and the venue may take photographs and video at the Festival, as described in our Waiver.

3. How we use information

• To sell and honor tickets and to run the Festival
• To answer your questions and requests
• To send you text messages and emails you have agreed to receive
• To announce hours, weather closures, and other updates about the Festival
• To understand how the Site is used and improve it
• To keep the Festival safe and secure, prevent fraud, and comply with the law

4. Text messaging (SMS)

If you opt in to text messages from the Houston Pumpkin Festival, we collect your mobile phone number and a record of your consent, including when and how you gave it. We use them only to send you the messages you signed up for (promotional messages, event announcements, ticket information, operating hours, special offers, and event updates) and to honor your requests to stop or get help. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We share it only with the service providers that deliver our text messages on our behalf, such as our messaging platform and wireless carriers, and only so they can do so. All of the sharing described in Section 5 excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

You can opt out at any time by replying STOP to any message, or get help by replying HELP. After you opt out, we keep your number on our do-not-text list so that we do not message you again.

5. How we share information

We do not sell your personal information. We share it only as follows:

• With service providers that work for us, such as our ticketing provider, payment processor, website host, analytics provider, and messaging platform, who may use it only to provide their services to us
• With the venue or emergency services when needed to respond to a safety or medical incident at the Festival
• When required by law, or to protect the rights, property, or safety of our guests, our staff, the public, or us
• In connection with a sale, merger, or transfer of our business, in which case this Privacy Policy will continue to apply to your information
• With your consent

6. Cookies and analytics

The Site uses Google Analytics to measure visits. Google Analytics sets cookies in your browser and collects the technical information described in Section 2. You can read how Google uses this information, block or delete cookies in your browser settings, or install the Google Analytics opt-out browser add-on. The Site works without these cookies.

7. How long we keep information

We keep personal information only as long as we need it for the purposes described in this Privacy Policy, including to meet legal, tax, and accounting requirements and to resolve disputes. We keep records of text message consent and opt-outs for as long as needed to show that we have honored them.

8. How we protect information

We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Your choices and rights

You can stop text messages by replying STOP, and stop marketing emails by using the unsubscribe link in any email. You can also ask us to access, correct, or delete the personal information we hold about you, or to provide a copy of it, by emailing thehoustonfamilyfun@gmail.com.

Depending on where you live, including Texas, you may have additional rights under state privacy law, such as the right to opt out of targeted advertising or profiling. We will respond to a request within 45 days. If we decline a request, you may appeal by replying to our decision, and we will respond to the appeal within 60 days. We will not discriminate against you for exercising any of these rights.

10. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child has given us personal information, please contact us and we will delete it.

11. Other websites

The Site links to websites we do not control, including our ticketing provider, Google Maps, and social media. Their own privacy policies govern the information they collect.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top of this page. We will not use your mobile number for a new purpose without your consent.
