1. Text messaging program

Program. Houston Family Fun LLC runs the Houston Pumpkin Festival text messaging program. If you opt in, you will receive recurring automated text messages from (281) 519-7385, including promotional messages, event announcements, ticket information, operating hours, special offers, and event updates about the Houston Pumpkin Festival.

Opting in. You can opt in by giving us your mobile number and agreeing to receive text messages, or by texting the keyword we advertise to (281) 519-7385. By opting in, you agree to these terms. Consent to receive text messages is not a condition of buying tickets or of any other purchase.

Message frequency varies.

Message and data rates may apply. Charges are billed by your wireless carrier under your mobile plan. Contact your carrier about your plan.

To cancel, text STOP to (281) 519-7385 or reply STOP to any message. We will send one message confirming that you have been unsubscribed, and you will receive no further messages unless you opt in again.

Carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless carrier and is not guaranteed.

Eligibility. You must be the account holder or an authorized user of the mobile number you enroll, and at least 18 years old or have the permission of a parent or guardian. If you change or give up your number, text STOP from it first.

Privacy. Our Privacy Policy explains how we handle your information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

2. Using this website

These terms also govern your use of houstonpumpkinfest.com (the “Site”). By using the Site, you agree to them. The Site is for your personal, noncommercial use. Dates, hours, prices, and attractions shown on the Site may change without notice, including because of weather.

The text, photographs, graphics, and logos on the Site belong to Houston Family Fun LLC or its licensors. You may not copy, reproduce, or reuse them for any commercial purpose without our written permission.

You agree not to interfere with the Site, attempt to gain unauthorized access to it, or use it for any unlawful purpose.

3. Tickets and admission

Tickets are sold through a third-party ticketing provider, and your purchase is also subject to that provider’s terms. Entry to the Festival is governed by our Waiver & Release of Liability and by the rules posted at the Festival.

4. Other websites

The Site links to websites we do not control, such as our ticketing provider, Google Maps, and social media. We are not responsible for their content or practices.

5. Disclaimers

THE SITE AND THE TEXT MESSAGING PROGRAM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

6. Limitation of liability

To the fullest extent permitted by law, Houston Family Fun LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or the text messaging program. Nothing in these terms limits the Waiver, which separately governs your attendance at the Festival.

7. Governing law

These terms are governed by the laws of the State of Texas without regard to its conflict of laws rules. Exclusive venue for any dispute lies in the state or federal courts located in Harris County, Texas.

8. Changes to these terms

We may update these terms from time to time. When we do, we will change the effective date at the top of this page. Continuing to use the Site or to receive text messages after an update means you accept the updated terms.
